Further ruling in patent dispute
Today saw the proceedings at the Federal Patents Court in connection with the patent dispute dating back several years between the companies Baldwin Germany GmbH and technotrans AG. The court's ruling rejected technotrans' revocation action against the disputed Baldwin patent. Once the written reasons given by the judges are obtained, technotrans intends to appeal to the Federal Supreme Court. The Board of Management believes such a course of action is justified for a variety of reasons, which include the fact that in the parallel infringement action the Federal Supreme Court had recently expressed the opinion in a suspension order that the prospects for technotrans' revocation action would definitely be bright on the grounds of inadmissible extension. The further proceedings, which could still take several years, currently have no effect on the future development of technotrans, as appropriate provisions were created back in 2002 and the production principle for the equipment in question has been changed.
